These Terms and Conditions govern your use of the Florster site and the Florster Service.

Florster puts the Web at the disposal of the Internet users so that they could know about Florster and the services offered by this online flower shop and contract them online if they wish it, to get in touch with Florster, to know the steps to be continued to buy the floral arrangements, the conditions of return, available forms of payment and etc.

Object and duration of the general conditions of use and contracting

The general conditions of use and contracting together with the Politics of privacy and the Politics of cookies regulate the relation of sale at distance between Florster and the user in accordance with the legal regulations, especially, the Law 7/1998, of April 13, about General Conditions of Contracting, the Law 3/2014, of March 27 that modifies the reruined text of the General Law for the Defense of the Consumers and Users, the Constitutional law 15/1999, of December 13, of Protection of Information of Personal Character, the Law 7/1996, of January 15 of Arrangement of the Retail trade, and the Law 34/2002, of July 11, of Services of the Information society and of Electronic commerce. The present general conditions will always be at your disposal on the Web so that you could consult them.

The present general conditions will be valid during the time that they are exposed on the Web, so that as soon as they are modified or updated whole or partially, the present conditions will stop being valid, being the new conditions of use those that will regulate the use of the Web, the contracting of the products and the relation between Florster and the users.

Florster informs the users that the present general conditions can change with the time. Consequently, Florster reserves the faculty to modify the present general conditions when it turns out to be necessary as a result of changes on the Web, modifications of Florster at corporative level, economic, operative or business circumstances or changes in the business model of Florster and/or legislative or jurisprudential innovations. Using this Web after these modifications have been published you confirm the acceptance of the above mentioned modifications noticing or not these changes.

The object of the web page is to offer and to advertise a sale of seasonal fresh flowers of all kinds chosen by Florster in every moment just as the decoration objects. Florster provides the above mentioned service exclusively in the municipalities of Barcelona, l'Hospitalet de Llobregat, Cornella de Llobregat, El Prat de Llobregat, S. Vicente dels Horts, Molins de Rey, Viladecans, Gava, Castelldefels, Esplugues de Llobregat, Sant Just Desvern, San Feliu de Llobregat, San Juan Despi, Sant Boi de Llobregat, Badalona, Sant Adrià del Besòs, Montgat, Sta Coloma de Gramanet, Moncada i Reixach, Cerdanyola, Ripollet, Sant Cugat del Vallès.

Entering the Web, the user declares to be adult and to have the necessary legal aptitude to enter the Web and to contract the services offered on the Web in accordance with the present general conditions that you declare to know, to understand and to accept entirely. The user can surf freely the Web and enter it so many times as he wants without need to subscribe or to register. Florster will not assume any responsibility on persons who break the present general conditions, the applicable current regulation or are under-age. Also, it is definitely prohibited any use of the Web in fraudulent, abusive, illicit or opposite to the good faith of the user manner.

To buy our floral arrangements you can go to the corresponding part of our online shop.

After completing the purchase you will receive a confirmation by e-mail. It is very important that during the buying process you indicate a valid e-mail. If in 24 hours from placing an order you do not receive the confirmation email, get in touch with Florster by phone or by e-mail pedidos@florster.com.

Also you can create an account on our Web in order to buy our flower arrangements. This will facilitate you to begin the buying process more rapid, to the information about your previous orders and will allow you to change your preferences of mailing and of payment.

Offer

In fulfillment of the current regulation Florster offers information about all the articles in sale, its characteristics and prices. Nevertheless, Florster reserves the right to withdraw, to restore or to change the products that are offered on the Web by means of the simple change in it’s content. Thus the products offered in every moment on the Web will be ruled by the current general contracting conditions in every case. Also, Florster will have the faculty to stop offering, without previous notice and in any moment, the access to the mentioned products.

Quality politics

Our floral arrangements are unique and different every day done with the best seasonal flowers therefore it is impossible that two equal exist. Although they are different every day and you can not choose exactly the flowers of the arrangement, the concept and the quality of our super flower arrangements are always guaranteed that is demonstrated by the photos of the Instagram of our incredible and proud clients because we do not use professional photographers programs as Photoshop to show on our Web the flower arrangements that are completely different from those that you will receive.

Service guarantee

Florster selects very carefully its providers of fresh flowers and seasonal flowers therefore it guarantees to the user the best service in any of its modalities.

Products and images

The products offered in our online flower shop incorporate a photo and their essential characteristics and only contain the elements specified in the descriptions. The vases and other articles are not included, unless it is indicated definitely in the description.

Price and delivery costs

All the products offered by Florster on its Web show the sale prices in Euros that are valid at the moment at which the User enters the Web and include the taxes and the delivery costs. The Value-added tax (VAT) will apply itself according to the corresponding type in accordance with the current legislation.

Florster reserves the right to change in any moment without previous notice and in a unilateral way the prices of the products offered on the Web although the above mentioned modification will not affect the orders that were placed previously by the user.

Changes in the order

To do changes in your order please contact with us sending a mail to pedidos@florster.com or calling 671157673. All changes should be done before our couriers go out with your order, this is at least five hours before the first hour of delivery. If your bouquet is already made, you can not change the order.

Forms of payment

You will be able to pay for your order choosing any of the following forms:

Credit card or debit card VISA or MASTERCARD.  All the operations that imply the transmission of personal or bank information are realized using a sure environment, a server based on the technology of standard safety SSL (Secure Sockets Layer). All the information that you give us travels coded through the network.  Also the information on your credit card is introduced directly on the page of the bank, in the TPV (Terminal Point of sale of the Bank) and it is not introduced nor registered on any Florster’s server.  Paying with VISA or MASTERCARD you will be always requested the following information: the number of card, the expiration date and a code of ratification that coincides with the last three numbers of the number printed in cursive on the reverse of your card VISA or MASTERCARD, offering thus more guarantees about the safety of the deal. This form of payment is valid only on the Web. If the sale’s amount is charged fraudulently or unduly using the number of a payment card, it’s holder will be able to demand the immediate annulment of the charge. In such a case the corresponding notes of debit and recredit in the accounts of the provider and of the holder will be carried out as soon as possible.   Nevertheless, if the purchase is done really by the holder of the card and the return demand is not a consequence of exercising the right of desistance or resolution and, therefore, the annulment of the corresponding charge is demanded unduly, the holder of the card will remain obligated to indemnify Florster all the dammages caused as a result of the above mentioned annulment.

Paypal: allows to send payments in Internet in sure and comfortable manner. The PayPal network is based on the existing financial infrastructure of bank accounts and credit cards to create a global payment solution in real time. Transference or bank deposit. If you wish you can also a simple transference. In this case you should only choose Bank deposit in the checkout and continue the indications.

Problems in the management of the payment

If for any circumstances you provide to us incorrect information about your credit card or method of payment we will not be able to process your order and therefore we will not be able to manage it and send it. We will get in touch with you to try to solve the problem, but Florster will not be responsable in any case of any problem that comes from it.

Cancellations

If you request the cancellation of your order before the delivery, we will detain it and will proceed to send to you the refund or change the date of your order according to your preferences.

Functioning of the Web

Florster needs the services provided by third parties to have the Web and its contents accessible. It is possible that in spite of the efforts that it makes to maintain available and accessible the Web it’s availability can become suspended, interrupted or cancelled due to causes alien to Florster. That’s why Florster does not guarantee the nonexistence of interruptions or errors in the access to the Web or its contents nor their updating or appearing in its last version. Consequently, Florster declines any responsibility for the damages that could derive to the user as a result of the suspension, interruption, lacking in continuity, fallen down of network or disconnection of the Web.

In any case and under any concept Florster will be responsable for the damages derived to the user as a result of causes not attributable to Florster such as, only like the examples and in any case limitative, natural disasters, situations of force majeure or extreme urgency, virus, harmful components, bad functioning of the navigator, computer intrusions or attacks of the third.

Jurisdiction

Florster reserves the faculty to present the civil or penal actions that it considers to be appropriate for the undue use of its Web and contents or for the non-fulfillment of the present conditions.

The relation between the user and Florster will be ruled by the current regulation applicable on the Spanish territory. In a case of any controversy the parts will be able to submit its conflicts to arbitration or come to the ordinary jurisdiction fulfilling with the norms of jurisdiction and competition in the courts of Barcelona.

Generalities

The titles contained in the present conditions are merely indicative or informative, so that they do not affect, qualify or extend their interpretation.

If any of the clauses contained in the present conditions was declared null, abusive or inapplicable, entire or partially, by a judicial or administrative institute, it will affect in an individual way only this clause, without affecting under any concept the rest of the conditions that will remain the same.
